The subject of this contract is the mutual rights and obligations of the parties, under Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, regarding the hotel accommodation service sold electronically by Seaview Faralya to the Customer through the website www.seaviewfaralya.com, whose qualities, sale price and conditions are set out below.

Service(s): the application offered by SEAVIEW FARALYA on the Website enabling customers to obtain information about the services of SEAVIEW FARALYA’s hotels, reserve a room for accommodation, make payments or purchase other products and services offered.

Content: all information, text, files, images, video, figures and similar visual, written and audio material published on and accessible through the Website.

User: any natural or legal person who visits and/or uses the Website.

Hotel: each of the accommodation facilities owned or operated by SEAVIEW FARALYA.

Website: the website through which SEAVIEW FARALYA offers its Services, consisting of the domain www.seaviewfaralya.com and its subdomains.

   The accommodation services offered by Seaview Faralya are displayed on the website www.seaviewfaralya.com. A Customer wishing to book selects check-in and check-out dates, the room and any extras in the booking flow on the site, enters guest details and confirms this contract together with the pre-contract information form. Payment is taken in full from a credit card on the same site, with the bank’s 3D Secure verification. This distance sales contract is concluded the moment the full booking amount is paid, and the booking confirmation is sent to the Customer by e-mail. The Customer may also contact the hotel’s sales consultant on WhatsApp; in that case the payment link sent to the Customer opens on www.seaviewfaralya.com as well and the same conditions apply.

   The Customer accepts, declares and undertakes that the details given during booking are correct. Should any of these details prove false or incorrect, Seaview Faralya has the right to terminate the contract unilaterally.

3. 3

   The Customer who becomes a party to the contract may not transfer the rights and obligations arising from it to third parties without the written consent of Seaview Faralya. By signing this contract the Customer permits Seaview Faralya to transfer its contractual rights and obligations to a third party and a third party to join the contract.

4. 4

   As a rule check-in is at 14:00 and check-out at 11:00; if an early check-out is wished, the hotel must be informed in advance. No refund is made if the Customer leaves the hotel early by their own choice.

   The accommodation price covers the room, dates and included services shown in the booking summary. Breakfast is included only where the booking summary says it is included. For White House stays, breakfast is included only if every occupied night falls within May through October. Services not shown as included in the booking summary are charged separately.

   The Customer pays the contract price at the time of booking by credit card or by bank transfer to the accounts indicated. For payments made by credit card, including mail order and virtual POS, VAT is included in the amount paid by the Customer.

   For credit card payments the Customer accepts and undertakes to pay, in addition to the contract price, any interest, deferred payment difference or exchange difference calculated and notified by the SELLER.

3. 3

   Instant booking confirmation: the booking confirmation can be printed by the Customer at the final step of the system and is also sent to the e-mail address given by the Customer. The invoice is issued after the stay and check-out and delivered to the Customer on request.

   Under Article 15 of the Regulation on Distance Contracts No. 29188, as the subject of this contract is an accommodation service to be provided on a specific date or period, the Customer cannot exercise the right of withdrawal.

   No refund is made to the Customer after the contract is concluded, for any reason whatsoever.

3. 3

   A Customer wishing to hold the booking open or change the dates must request this from Seaview Faralya in writing at least 21 days before the check-in date.

   In the event of a booking change or holding the booking open, these rights belong to the person who made the payment at the time of booking.

Seaview Faralya may cancel or postpone the stay owing to adverse weather, road obstruction, natural disaster, social unrest, international relations, war, terrorism, unforeseeable technical failure, epidemic, strike, protest, bankruptcy and similar events occurring between, at the start of or before the booking dates. The facility cannot be held responsible where the hotel service is incomplete or cannot be provided. In such cases Seaview Faralya bears no responsibility whatsoever and the Customer may not make any claim.

   The Customer accepts, declares and undertakes in advance to comply with the hotel rules notified during and after the booking discussions, and that Seaview Faralya may end the stay for just cause in the event of conduct to the contrary.

   It is the duty of care of the Customer acting in good faith to notify the responsible person in writing, during the provision of the service, of any matters complained of. Using the service to the end without notifying Seaview Faralya of the complaint removes the Customer’s rights to compensation such as substitute service and refund regarding the matters complained of.

   Information on the hotel’s location, structure and surroundings, safety measures and precautions to be taken is explained to the Customer at check-in. Within this scope the Customer must take all precautions regarding the safety and storage of valuables, money and jewellery in their possession. Seaview Faralya bears no responsibility.

   Even if the Customer has been unable to sign this hotel booking contract for any reason, having purchased it by mail order, virtual POS, bank transfer or EFT, the Customer has learned the terms of this contract, valid between the parties, from catalogues, the website or advertisements and has undertaken to purchase this hotel booking under the terms written in this contract.

   The Customer accepts, declares and undertakes in advance that the charges for extra food and drink and services outside the system consumed at the facility are their own.

   The address given by the Customer on www.seaviewfaralya.com is deemed the true, correct and valid address for notices. Notices sent to these addresses are valid under Article 21 of the Turkish Notification Law; if the address changes, the new address must be notified to Seaview Faralya within 3 (three) days.

   The Customer undertakes that they have signed this contract after reading it, having obtained all information about the hotel named in this booking and contract from the Seaview Faralya web address and the information message sent on WhatsApp, and having made all necessary examination.

8. 8

   Customer(s) who take part in the service subject to the contract without signing it are deemed to have accepted and undertaken its provisions by the reading and signing of this contract by the persons they authorised to register on their behalf. Seaview Faralya reserves the right of recourse against the other customers for the collection of any excess amount or service fee paid to the persons whose signature appears on the contract.

   In the event of a conflict between the copy of the contract held by the Customer and the copy held by Seaview Faralya, the records of the copy held by the hotel prevail. All e-mail and fax correspondence between the parties constitutes conclusive evidence, and the company records are the basis. The parties accept that the addresses and telephone numbers they have given are valid for all communication and notices, and that unless a change is notified to the other party in writing, all notices and communications sent to those addresses and numbers are deemed served.

    This contract, its annexes, advertisement pages, information messages and all contracts to be signed between the parties are deemed a whole.

11. 11

    The Courts and Enforcement Offices of Fethiye have jurisdiction over disputes arising from the application and interpretation of this contract, its annexes and integral parts, and from failure to fulfil its terms. Turkish law applies to such disputes.

    Any amendment or addition to the contract is subject to the written form to be signed by both parties. The Customer accepts, declares and undertakes not to request or sue for the adaptation of the contract to current conditions after its conclusion for reasons such as economic crisis, inflation, devaluation, rises in exchange rates or parities.

13. 13

    The Customer must read, understand and sign this distance sales contract prepared by Seaview Faralya. The contract text is published on the website where the booking is made. The contract is also sent at the time of booking to the e-mail address given by the Customer. Seaview Faralya is ready to provide a copy of the contract to the Customer on request.

14. 14

    This Distance Sales Contract enters into force on the date it is published on the Website by SEAVIEW FARALYA.

15. 15

    By using the Website the Customer is deemed to have accepted this 4-page Sales Contract and the amendments made to it over time.
