• PARTIES This contract (hereinafter referred to as the "CONTRACT") has been signed between the parties specified below. SEAVIEW FARALYA TOURISM AND TRADE LIMITED COMPANY, located at Faralya Mahallesi, Kızılcakaya Sokak No: 90, 48500 Fethiye/MUĞLA, hereinafter referred to as "SEAVIEW FARALYA". And the customer who makes a reservation through the system, by entering and confirming all their personal information, and accepting the following terms in advance, with their TC (Turkish Identity) number or passport number in the reservation form, hereinafter referred to as the "CUSTOMER".

    SUBJECT OF THE CONTRACT

  • The subject of this contract; involves the hotel accommodation sales service electronically provided by Seaview Faralya via its website www.seaviewfaralya.com, with the specifications, sales price, and terms detailed below, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation, encompassing the mutual rights and obligations of the parties.

    DEFINITIONS

  • Service(s): The application provided by SEAVIEW FARALYA that allows customers to obtain information about the services offered by its hotels, reserve rooms for accommodation, make payments, or purchase other products and services. Content: All kinds of information, text, files, images, videos, numbers, etc. visual, textual, and auditory images published and accessible on the website. User: Refers to all real or legal persons who visit and/or use the website. Hotel: Each accommodation facility owned or operated by SEAVIEW FARALYA. Website: The website www.seaviewfaralya.com, consisting of its main domain and subdomains, where SEAVIEW FARALYA offers its services.

    RESERVATION

  • The accommodation services offered by Seaview Faralya are displayed on the website www.seaviewfaralya.com and marketing channels of domestic and international business partners. To make a reservation, the customer selects the reservation link on the website and directly contacts the hotel sales consultant via WhatsApp. Pricing, availability calendar, and general rules are communicated, and a reservation link is sent to the customer's email. When the customer opens this link in their browser, they complete the reservation through www.seaviewfaralya.com and the distance sales contract is established when the full reservation amount is paid.

  • The customer agrees, declares, and undertakes that the information they provided during the reservation is correct. If any of the information provided by the customer is found to be false or incorrect, Seaview Faralya has the right to unilaterally terminate the contract.

  • The customer, as a party to the contract, cannot transfer their rights and obligations arising from this contract to third parties without Seaview Faralya's written approval. By signing this contract, the customer permits Seaview Faralya to transfer its rights and obligations arising from the contract to a third party and allows a third party to join the contract.

  • As a rule, the check-in time for the hotel is 14:00, and the check-out time is 11:00. If the customer wishes to check out early, they must inform the hotel staff in advance. If the customer leaves the hotel early by their own will, no refund will be provided.

    CONTRACT FEE AND PAYMENT TERMS

  • The accommodation and breakfast are included in the fee, while additional services are subject to extra charges. The customer pays the contract fee via credit card or bank transfer/EFT to the specified bank accounts at the time of reservation. For payments made by credit card, an additional 10% VAT will be paid by the customer, including mail order and virtual POS fees.

  • The customer agrees and undertakes to pay any interest, installment fees, and exchange rate differences, calculated and notified by the SELLER, in addition to the contract fee for credit card payments.

  • Instant Reservation Confirmation: Reservation approval can be printed by the customer at the final stage of the system, and it will also be sent to the email address provided by the customer. The invoice will be issued after the accommodation and checkout, and will be delivered to the customer upon request.

    CANCELLATION AND MODIFICATION

  • According to Article 15 of the Regulation on Distance Contracts No. 29188; since the subject of this contract involves accommodation services to be provided on a specific date or period, the customer cannot exercise the right of withdrawal.

  • No refund will be made to the customer for any reason after the contract is concluded.

  • Customers who wish to defer their reservation or make a date change must request it in writing from Seaview Faralya at least 21 days before the check-in date. In case of reservation change or deferral, the rights to use this option belong to the person who made the payment during the reservation.

    FORCE MAJEURE

  • Seaview Faralya may cancel or postpone the accommodation due to any adverse weather conditions, roadblocks, natural disasters, social events, international relations, war, terrorism, unforeseen technical failures, epidemics, strikes, protests, and bankruptcy, among other reasons, during or before the reservation dates. The hotel cannot be held responsible for any failure or inability to provide services. In this case, Seaview Faralya is not liable, and the customer cannot make any claims or demands for compensation.

    GENERAL TERMS

  • The customer agrees, declares, and undertakes to comply with the hotel rules communicated to them during and after the reservation process. If they act otherwise, Seaview Faralya has the right to terminate their accommodation for just cause.

  • The customer has the obligation to report any complaints during the service delivery to the authorized personnel in writing. If the customer uses the service to the end without notifying Seaview Faralya about their complaints, they forfeit any rights to compensation, including replacement services or refund.

  • Information about the hotel's location, structure, surrounding environment, security measures, and precautions will be explained to the customer at the time of check-in. In this regard, the customer is responsible for taking all necessary precautions to secure and store their valuables, money, and jewelry. Seaview Faralya is not responsible for these items.

  • The customer agrees and undertakes that even if they could not sign this hotel reservation contract for any reason, they have learned about the terms of this contract from the catalog, website, or advertisements and have committed to accept the terms in writing.

  • The customer agrees, declares, and undertakes to cover the costs of extra food and beverages and off-system services at the facility.

  • The address provided by the customer through www.seaviewfaralya.com is accepted as the valid notification address. Notifications sent to this address will be deemed valid as per Article 21 of the Turkish Commercial Code. If the address changes, it must be communicated to Seaview Faralya within 3 (three) days.

  • The customer undertakes to read and sign this contract after receiving all necessary information about the hotel mentioned in the contract from the Seaview Faralya website and WhatsApp, and after conducting any required review.

  • Customers who have not signed the contract but participated in the service covered by the contract are considered to have accepted the terms of the contract through the signatures of the person who registered on their behalf.

  • If there is a discrepancy between the copy of the contract kept by the customer and the one kept by Seaview Faralya, the records held at the hotel will prevail. Any emails or faxes exchanged between the parties will be considered definitive evidence, and company records will be the primary reference. Both parties accept and declare that the addresses and phone numbers they have provided are valid for all communications and notifications. Any changes to these addresses and phone numbers must be communicated in writing, otherwise, notifications made to the provided contact details will be deemed delivered.

  • This contract, its annexes, advertising pages, informational messages, and all other contracts to be signed between the parties will be considered as a whole.

  • Any disputes arising from the application and interpretation of this contract, its annexes, and inseparable parts, and the failure to fulfill the terms of the contract will be resolved by the Fethiye Courts and Enforcement Offices. Turkish law will apply to these disputes.

  • Any changes or additions to the contract must be made in writing and signed by both parties. The customer agrees, declares, and undertakes not to request or litigate adjustments to the contract in the future due to reasons like economic crisis, inflation, devaluation, changes in exchange rates, and parity.

  • The customer must read, understand, and sign this distance sales contract prepared by Seaview Faralya. The contract text is shared on the website where the reservation is made, and it is also sent to the customer's email address at the time of reservation. Seaview Faralya is ready to provide a copy of the contract to the customer upon request.

  • This Distance Sales Contract becomes effective on the date it is published on the Website by SEAVIEW FARALYA.

  • The customer acknowledges and agrees that by using the Website, they have accepted this 4-page Sales Contract and any changes made over time.
